Abstract: | En este trabajo se aborda el estudio de los conflictos derivados de la falta de acuerdo de los progenitores en la elección del tipo de formación religiosa que quieren para sus hijos/as. Para ello es necesario detenerse, en primer lugar, en el estudio del contenido y alcance del derecho de los padres a educar a sus hijos/as de conformidad con sus propias convicciones —art. 27.3 CE—, para después examinar sus posibilidades de ejercicio en las disputas indicadas, teniendo en cuenta, como no podía ser de otro modo, el derecho a la libertad religiosa de los menores de edad en conexión con la protección de su interés superior. Por último, se analiza la praxis judicial española con la intención de plantear propuestas que permitan avanzar en la salvaguarda de los derechos de los menores en un ámbito en el que la interpretación judicial se muestra todavía alejada de los estándares de protección garantizados por la Convención sobre los Derechos del Niño. Estas carencias, sin embargo, parecen haber sido resueltas en el ámbito legislativo mediante la reforma de la Ley Orgánica de Protección Jurídica del Menor —2015— que acoge los criterios establecidos por la ONU en la interpretación del interés superior del menor y, sobre todo, del derecho del menor a ser escuchado en cualquier asunto que le afecte. | This paper deals with the study of the disputes between parents over children's religious instruction. This requires the study of the right of parents to educate their children in conformity with their own convictions (art. 27.3 CE) and then examine their ability to exercise the indicated disputes, taking into account the religious rights of children and the protection of their best interest. It will then examine how courts have handled child custody cases involving disputes between parents with the intention to put forward proposals in advancing children's rights in an area that judicial interpretation is still far from the standards of protection guaranteed by the Convention on the Rights of the Child. These shortcomings seem to have been resolved by the reform of the Organic Law 1/1996 on the legal protection of minors (2015) which introduces the criteria established by the UN in the interpretation of a child's best interests and, especially, the right of all children to be heard in all matters affecting her or him. |
