Resum: | El presente trabajo busca controvertir dos ideas centrales del análisis crítico presentado por Redondo, a saber: (i) sugerir que la teoría de E. Bulygin no entrega criterios que permitan identificar su objeto de estudio y que esta indeterminación posibilita vincular su obra con distintos positivismos (simple, incluyente o excluyente) según qué texto sea revisado; y, a modo de conclusión, (ii) asumir que la falta de una posición clara respecto de la segunda cuestión (positivismos) implica una falta de respuesta a la primera (cómo identificar el objeto de estudio). Así, por un parte, el artículo defiende que la teoría del derecho de Bulygin entrega una respuesta a cómo identificar su objeto de estudio, junto con presentar esta respuesta bulyginiana y, por otra parte, muestra cómo dicha respuesta se vincula con un positivismo excluyente, el cual es esbozado. | The present study aims to discuss two main ideas of the critical analysis presented by Redondo. That is, (i) to suggest that Eugenio Bulygin’s theory does not provide criteria that allow the identification of the subject of study and that this indeterminacy enables to connect his work with different positivisms (simple, inclusive or exclusive) depending on the text referred to. And, as a conclusion, (ii) to assume that the lack of a clear position regarding the second issue (positivisms) implies a lack of response to the first point (how to identify the subject of study). In this regard, on one hand, this research advocates that the Bulygin’s theory of law provides a response about how to identify the subject of study, along with this own Bulyginian response; and, on the other hand, to demonstrate how such response may be linked with an exclusive positivism, which is also briefly addressed. |
