Abstract: | Este trabajo analiza la posibilidad de adquirir por usucapión los elementos comunes poseídos por un propietario de forma exclusiva y excluyente en el ámbito de la propiedad horizontal y los problemas que se pueden derivar a la hora de reflejar la adquisición de su derecho en el Registro de la Propiedad. Esta cuestión, de atractivo interés y evidente aplicación práctica, no ha sido claramente resuelta por una jurisprudencia que en la mayoría de los casos considera que estamos ante una posesión tolerada por el resto de vecinos, pero que también pone en valor el transcurso del tiempo sin reacción de la comunidad ante obras inconsentidas en elementos comunes. | This paper analyzes the possibility of acquiring through acquisitive prescription the common elements in a horizontal property regime when they have been possessed in an exclusively manner by one of the co-owners, such as the problems that derive when reflecting the acquisition of their right in the Land Registry. This question of crucial interest and evident practical application has not been clearly solved in case law. In most cases courts point out that possessory acts allowed by mere tolerance of the rest of co-owners do not enable acquisitive prescription but on the other hand, courts also acknowledge some effects to the course of time when an owner makes some construction in communal areas of the property without due permission of the community. |
