Consolidación de dominios en las Pías Fundaciones del Cardenal Belluga (Bajo Segura)

Abstract

Se analiza en este artículo el desmoronamiento y desintegración de las Pías Fundaciones creadas por el Cardenal Belluga en el Bajo Segura durante la primera mitad del XVIII. Merced a su enorme influencia, el prelado obtuvo mediante cesiones diversas una superficie en torno a 40.000 tahúllas (4.472 ha.) de humedales y terrenos pantanosos, que fueron saneados y en su gran mayoría establecidos a censo enfitéutico. Una serie de valiosos estudios han analizado la vida y la obra de Belluga, pero apenas se había investigado el desmantelamiento por las disposiciones desamortizadoras de las Pías Fundaciones. Mermadas con motivo de la real orden de 25 de septiembre de 1798 y declarado en estado de venta el patrimonio subsistente por ley de 1 de mayo de 1855, la consolidación de dominios se efectuó, empero, al amparo de la poco conocida ley de 11 de marzo de 1859. A través de la Contaduría de Hipotecas se ha podido documentar el proceso de redención de censos por los enfiteutas. Objeto de consideración es asimismo la problemática planteada en el término de Dolores por la devolución a la Casa de Rafal, en cumplimiento de sentencia del Tribunal Supremo, de las tierras de Majada Vieja.

This article analyses the decline and desintegration of the Pías Fundaciones founded by Cardenal Belluga in the Bajo Segura during the first half of the Eighteenth Century. Due to his huge influence, the Prelate obtained through several grants a surface of about 40.000 «tahúllas» (4.472 hectares) of marshlands, wich were drained and most of them established by census emphyteuticus. A series of valuable studies have analysed the life and works of Belluga, yet and investigation of the dilapidation of the Pías Fundaciones by the desamortization dispositions has hardly taken place. A Royal Order on the 25th of September 1798 reduced the heritage, and the Act of the 1st of May 1855 declared in selling condition the heritage still existing, however the consolidation of domains was carried out protected by the slightly know Act of 11th of March 1859. Through the Contaduría de Hipotecas (Mortages Accounts Departament) it has been possible to document this process. Another subject of consideration is the cuestion raised in the township of Dolores when, by sentence of the High Court, the lands of Majada Vieja were returned to the Casa de Rafal.
