Abstract: | En los últimos años hay un renovado interés por la usucapión, como consecuencia de recientes decisiones del Tribunal Supremo que han estimado inviable que la acción reivindicatoria prescriba sin una usucapión consumada. Aprovechando este interés, es un buen momento para reflexionar sobre un tema conocido, de importancia práctica indudable, pero paradójicamente muy poco tratado en la doctrina: la alegación de los efectos de la usucapión en el juicio seguido por acción reivindicatoria. La usucapión ganada ha constituido en muchos litigios el principal argumento de defensa del demandado. Ahora bien, el usucapiente demandado puede o no hacer valer la usucapión y si la quiere hacer valer tiene varias formas posibles, que son precisamente el objeto de este trabajo. | In the last years there is a renewed interest for the usucapion, as consequence of recent decisions of the Supreme Court that have considered unviable that the revendication prescribes without a gained usucapion. Taking advantage of this interest, it is a good moment to think about a known topic, of practical undoubted importance, but paradoxically very little treated in the doctrine: the allegation of the effects of the usucapion in the judgment followed by revendication. The gained usucapion has constituted in many litigations the principal defense argument of the defendant. But the certain thing is that the demanded possessor can or not invoke the usucapion and if it wants to make it has several possible forms, which are precisely the object of this work. |
