| In the last years there is a renewed interest for the usucapion, as consequence of recent decisions of the Supreme Court that have considered unviable that the revendication prescribes without a gained usucapion. Taking advantage of this interest, it is a good moment to think about a known topic, of practical undoubted importance, but paradoxically very little treated in the doctrine: the allegation of the effects of the usucapion in the judgment followed by revendication. The gained usucapion has constituted in many litigations the principal defense argument of the defendant. But the certain thing is that the demanded possessor can or not invoke the usucapion and if it wants to make it has several possible forms, which are precisely the object of this work. |
