| The objective of this article is to discuss the duties of the judge i.e. the guarantees of the jurisdiction, and to construct its image based on those guarantees. The duty to apply the Law coincides with what is generally called the “objective guarantee of jurisdiction” and the duties of independence and impartiality with the “subjective guarantees of jurisdiction”. The analysis demonstrates that in practical terms, the non-fulfilment of the subjective guarantees is a potential higher delegitimizer of non-fulfilment of the objective guarantee. Furthermore, in conceptual terms, the notions of independence and impartiality are dependent on the commonly-held concept of Law. |
