Abstract: | Dentro de las cláusulas que han producido más litigiosidad en materia de préstamos hipotecarios, destacan las que se refieren a los pactos relativos al cálculo, variabilidad y cuantía de los intereses remuneratorios. Entre ellas, las cláusulas de redondeo al alza del tipo de interés variable, las cláusulas suelo, las que han utilizado como índice de referencia el IRPH, las que indexan el capital a una divisa extranjera (hipotecas multidivisa) y también las que acuerdan calcular el interés del préstamo conforme al año comercial (de 360 días) y no con el año natural (de 365 días). A pesar de referirse todas ellas al objeto principal del contrato de préstamo (los intereses remuneratorios), no todas son descriptivas o definitorias del mismo y han de juzgarse conforme a criterios de transparencia, como muestra la jurisprudencia del TS y del TJUE. | Among the clauses that have produced more litigation in terms of mortgages, the ones that stand out are those referring to the agreements related to the estimate, variability and amount of remuneratory interest rate. Among them, the rounding up clauses of the variable interest rate, the «floor clauses», those that have used «IRPH» as a reference index, those that index the capital to a foreign currency (multi-currency mortgages), and also those that agree to calculate the loan’s interest according not to the calendar year (of 365 days), but to the commercial year (of 360 days). Although all of them refer to the main subject matter of the loan contract (the remuneratory interests), not all of them are descriptive or defining of it, and must be judged according to the control of material transparency, as the Supreme Court and the Court of Justice of the European Union case-law denotes. |
