| Among the clauses that have produced more litigation in terms of mortgages, the ones that stand out are those referring to the agreements related to the estimate, variability and amount of remuneratory interest rate. Among them, the rounding up clauses of the variable interest rate, the «floor clauses», those that have used «IRPH» as a reference index, those that index the capital to a foreign currency (multi-currency mortgages), and also those that agree to calculate the loan’s interest according not to the calendar year (of 365 days), but to the commercial year (of 360 days). Although all of them refer to the main subject matter of the loan contract (the remuneratory interests), not all of them are descriptive or defining of it, and must be judged according to the control of material transparency, as the Supreme Court and the Court of Justice of the European Union case-law denotes. |
