Abstract: | La inacción por parte del Estado salvadoreño a la hora de perseguir los crímenes cometidos en su territorio ha impedido la lucha contra la impunidad. La aplicación del principio de Jurisdicción Universal se convierte así en un mecanismo alternativo para juzgar a todos aquellos individuos acusados de cometer delitos graves tipificados en el Derecho Internacional perpetrados en territorio salvadoreño. La intervención del Derecho Penal Internacional en este caso se ha realizado bien desde tribunales internacionales, la Corte Interamericana en el caso de las Masacres del Mozote, bien desde tribunales nacionales en el ejercicio extraterritorial universal de sus competencias, como ha sido el caso de la justicia española con la sentencia referida al asesinato del jesuita Ignacio Ellacuría. Dos sentencias relativamente recientes, que señalan que la vía internacional, aun con muchas limitaciones, puede convertirse en el camino más directo para poner fin a la impunidad en El Salvador e iniciar la senda del progreso basado en la justicia y la reconciliación. | The inaction by the Salvadoran State to prosecute crimes committed in its territory has impeded the fight against impunity. The application of the principle of Universal Jurisdiction becomes an alternative mechanism to try all those individuals accused of committing serious crimes typified in International Law perpetrated in Salvadoran territory. The intervention of International Criminal Law in this case has been carried out, either from international courts, the Inter-American Court in the case of the Mozote Massacres, or from national courts in the universal extraterritorial exercise of their powers, as has been the case of the Spanish justice with the sentence referring to the murder of the Jesuit Ignacio Ellacuría. Two relatively recent rulings, which indicate that the international route, even with many limitations, can become the most direct way to end impunity in El Salvador, and start the path of progress based on justice and reconciliation. |
