L'adaptació lingüística en els procediments judicials en què intervé un intèrpret: realitat, motivació i conseqüències en el marc del procés penal a Espanya

Abstract

La interpretació judicial i el paper de l’intèrpret és una realitat que ha rebut l’atenció de la lingüística forense, sobretot en el pla internacional. Estudis com els de Berk-Seligson (1990) o Hale (2004) apunten el fet que determinades decisions lingüístiques i usos discursius per part de l’intèrpret poden tenir importants repercussions en la percepció que els operadors jurídics es fan dels testimonis prestats pels integrants de la minoria lingüística i del valor i credibilitat que els concedeixen. D’aquí prové la necessitat de comprovar si el que observem en altres ordenaments jurídics és també vàlid en el cas d’Espanya. Des dels estudis de traducció i interpretació, i mitjançant investigacions de naturalesa descriptiva, també s’ha produït un apropament a la realitat discursiva dels processos multiculturals i multilingüístics en què intervé un intèrpret (Ortega Herráez 2006). Aquest article abordarà la realitat de l’adaptació lingüística del discurs per part de l’intèrpret judicial i reflexionarà sobre les motivacions i conseqüències d’aquesta adaptació.

Legal interpreting and the role of the interpreter are established realities that have become part of the forensic linguistic process, particularly at the international level. Studies by experts such as Berk-Seligson (1990) and Hale (2004) point to the fact that certain linguistic decisions and uses of discourse by the interpreter can have major repercussions on the interpretation that agents in the judicial process make of statements given by members of minority language groups, and on the value and credibility afforded these statements. As such, it is necessary to verify whether the problems observed in other legal systems also apply in the Spanish case. From a starting point of descriptive translation and interpreting studies, research in this area has shed light on the discursive phenomena that characterize the multicultural and multilingual processes in which an interpreter intervenes (Ortega Herráez 2006). This article focuses on the linguistic adaptation of discourse by the legal interpreter and offers reflections on the motivations for and consequences of this adaptation.
