| The purpose of this paper is to resolve the numerous interpretative doubts that Article 1910 of Spanish Civil Code generates today. These doubts not only have a clear theoretical repercussion, but they also manifest themselves in the practice of Spanish Courts, due to the litigiousness of this matter. For that reason, the analysis of each of the elements that make up the Article will be complemented with the most relevant case-law on the subject. We hope that this study will shed some light on the vague conceptualization chosen by the legislator of 1889. |
