Abstract: | En este trabajo se pretende poner de manifiesto la problemática aplicación de la actuación judicial automatizada y la IA en la Administración de Justicia, así como realizar propuestas tendentes a conseguir su efectiva implantación. Con este propósito se analizarán diversos aspectos: (1) los datos y la reutilización como base de la IA (2) la seguridad e interoperabilidad de las tecnologías de procesamiento de datos como presupuesto (3) el marco legal de referencia de la aplicación de las TIC a la Administración de Justicia (4) las técnicas de automatización e IA y su significado y alcance en la justicia, y, finalmente (5) una conclusión a modo de propuestas para posibilitar su implantación. | The aim of this paper is to highlight the problematic implementation of automated judicial action and AI (artificial intelligence) in the Administration of Justice, as well as to make proposals aimed at achieving its effective implementation. For this purpose, various aspects will be analysed: (1) data and reuse as a basis for AI; (2) security and interoperability of data processing technologies as an assumption; (3) the legal framework of reference for the application of ICT to the Administration of Justice; (4) automation and AI techniques and their meaning and scope in justice; and finally (5) a conclusion by way of proposals to enable their implementation. |
