El «sexting» entre menores y el delito de pornografía infantil en Italia

Abstract: 
Cada vez está más extendida entre los menores la práctica del sexting, esto es, el envío de fotografías o vídeos de contenido sexual a través del teléfono móvil u otro dispositivo electrónico. El presente trabajo analiza la respuesta del Ordenamiento jurídico italiano a esta nueva conducta, que sanciona al menor que recibe y difunde la imagen íntima de otro como autor de un delito de pornografía infantil (arts. 600-ter y quarter CP).
Sexting, a popular practice among children consisting in the transmission of photographs or videos of sexual content through the mobile phone or other electronic devices, is becoming increasingly common among this population group. This paper analyzes the response of the Italian legal system to this behavior, which punishes the child who receives and disseminates the intimate images of other minors, considering them as the perpetrator of a child pornography offence (articles 600-ter and quarter Italian Criminal Code).
