Abstract: 
Desde hace unos años, el gobierno español viene planteando la creación de registros de delincuentes sexuales como forma de prevención de nuevos casos. Dado que los detalles de su configuración todavía no se conocen, surgen toda una serie de incógnitas al respecto. En última instancia, la gran pregunta es si se trata de una herramienta adecuada para la prevención de delitos en general y, sobre todo, si esta iniciativa tiene encaje en el marco de nuestro ordenamiento. En este contexto, resulta especialmente oportuno examinar la experiencia de otros países en la aplicación de esta medida. Destaca en este sentido el caso estadounidense, donde los registros se emplean desde hace décadas, son de acceso público en Internet y llevan aparejados otras gravosas medidas como la notificación a la comunidad o las restricciones en el establecimiento de domicilio.
Over the past few years, the Spanish government has been pondering the establishment of a sex offender registry as a means to prevent new crimes. As the exact features of such a registry are still unknown, there are a number of aspects to be examined. Ultimately, the most important questions are whether it is an effective mechanism to prevent crime in general and to avoid recidivism of sex offenders in particular. And, most importantly, whether such a mechanism is legal in a democracy. It is therefore especially interesting to examine other countries’ experience in this regard. In the United States of America, these registries have been up and running already for decades, are completely public and accessible in the Internet, and entail other burdensome measures such as community notifications or residency restrictions. A thorough analysis of the legal status of the registries and of the consequences of these measures, as well as the relevant case law regarding their constitutionality will be carried out.
