Abstract: 
En el presente trabajo, se aborda el pensamiento de Manuel Atienza a partir sus discrepancias principales, a pesar de su esencial coincidencia, con el postpositivismo discursivo, modelo teórico que comparten autores como Carlos Nino y Robert Alexy. De esta manera, se obtienen algunas conclusiones sobre el pensamiento postpositivista del autor español.
In the present work, the thought of Manuel Atienza is approached based on its main discrepancies, despite its essential coincidence, with discursive postpositivism, a theoretical model shared by authors such as Carlos Nino and Robert Alexy. In this way, some conclusions are obtained about the postpositivist thought of the Spanish author.
