Abstract: 
Este trabajo realiza una propuesta de interpretación del actual marco legal de la transferencia de tecnología entre Administraciones, en el que existe una laguna legal en relación a la utilización conjunta y continuada en el tiempo de aplicaciones y plataformas entre dos o más Administraciones y/o entidades del Sector Público. Se trata de una problemática no resuelta por la normativa española ni tampoco de la Unión Europea. Las soluciones jurídicas se aportarán en base a la aplicación por analogía de determinados artículos que regulan esta cuestión, y del análisis de dos Sentencias: (1) la STC 55/2018 y (2) la STJUE C-796/18 ISE/Colonia.
This paper aims to make an interpretative proposal that covers the existing legal gap in the matter of transfer and re-use of technology when the technology transfer agreement regulates the continued use and all of the same by the Administrations. Neither Spanish legislation nor Directive 24/2014 resolve this problematic issue. The objective of this work will be to analyze the regulations and jurisprudence, specially the Spanish Constitutional Court STC 55/2018 and the Judgement «C-796/18» of the Court of Justice of the European Union «Informatikgesellschaft für Software-Entwicklung,» to provide solutions to resolve the insufficient legal framework of the technology transfer.
