De la muerte del autor a la muerte del legislador. La interpretación constitucional desde el derecho como literatura

Abstract: 
La finalidad del presente trabajo es mostrar cómo los estudios interdisciplinarios entre los campos del derecho y la literatura pueden contribuir con el debate, en torno a la interpretación jurídica y al papel de aquello que realmente tienen los operadores jurídicos en la decisión de cuestiones constitucionales. En un primer momento, se reseñan los posibles puntos de encuentro entre derecho y literatura, así como las distintas manifestaciones que estos pueden adoptar. Luego, desde el derecho como literatura, se examina la propuesta semiológica de Roland Barthes, específicamente su teoría acerca de «La muerte del autor». Finalmente, se muestra cómo el instrumental por él acuñado constituye una de las herramientas, que mejor describe la mecánica de la actual interpretación constitucional en algunos ordenamientos jurídicos, desembocando en lo que denominaremos como «La muerte del legislador».
The purpose of this paper is to show how interdisciplinary studies between the fields of law and literature can contribute to the debate on legal interpretation, and to the role of what legal operators actually do when deciding constitutional issues. First, we will review one of the possible meeting points between law and literature —i.e. law as literature— and we will examine Roland Barthes’ semiological proposal, specifically his theory about «The Death of the Author»; from there on, we will show how the ideas and concepts he coined constitute one of the tools that best describe the mechanics of the current constitutional interpretation in some legal systems. This will lead to what we will call «The Death of the Lawmaker».
