Abstract: | El presente trabajo constituye una primera aproximación a las normas sobre competencia judicial internacional de origen convencional e interno del sistema de Derecho internacional privado peruano. Con carácter general se puede considerar una regulación completa y coherente si bien la jurisprudencia en la materia es muy escasa. Entre sus particularidades se puede mencionar la existencia del forum causae en materia de Derecho de persona y familia, y de normas sobre litispendencia internacional y de no competencia. Aunque las soluciones aportadas se pueden considerar adecuadas, resulta precisa una adecuación por vía interpretativa a los nuevos condicionantes del comercio internacional. | The objective of this work is to provide a first approach to the international and national rules on jurisdiction of the Peruvian Private International Law system. Generally speaking, the regulation is complete and coherent but the case law in the field is scarce. Among the particularities of the regulation, it is worth to mention the use of forum causae for actions in family and personal matters, and the existence of rules on international lis pendens and decline of jurisdiction. While the solutions that these rules provide can be considered as adequate, an adaptation to the existing circumstances of international commerce is needed by means of interpretation. |
