Introducción a la filosofía del Derecho de Manuel Atienza

Abstract

La obra de Manuel Atienza abarca un amplio abanico de problemas iusfilosóficos. En este artículo presento una introducción a su pensamiento tomando como hilo conductor la idea de protección de los derechos. Se expone su teoría de la racionalidad jurídica y cómo se vertebran las tres instituciones fundamentales en las que se mueve el fenómeno jurídico: la legislación, la jurisdicción y la dogmática jurídica. Todo ello desarrollado desde una concepción postpositivista que pretende la transformación social por medio del Derecho.

Manuel Atienza’s work covers a wide range of legal-philosophical problems. In this article I present an introduction to his thought, taking the idea of the protection of rights as a guiding thread. It sets out his theory of legal rationality and how the three fundamental institutions in which the legal phenomenon moves: legislation, jurisdiction and legal dogmatics. All of this is developed from a postpositivist conception that aims for social transformation through Law.
