El recurso especial en materia de contratación en España. Configuración actual, especialidades y última reforma

Abstract

The aim of this study is to offer an exposition of the legal regime that is established in Spain for the so-called “special administrative appeal in contracting matters”. A regime that, after various reforms, is contained in the current Administrative Contract Law of 2017, a law that very recently -in December 2020- has been modified again and of which we intend, with regard to the indicated “special administrative appeal”, to offer a updated vision. We will address the regulatory evolution and explain the current one, with special attention to procedural aspects and to the competent bodies for the resolution of it.
